These terms are between Wetstone Technologies Limited. ("wetstone.co.nz") and you ("Client"). Wetstone Technologies is a web solutions and services company. From hereinafter Wetstone Technologies will be referred too as 'Wetstone', 'our', 'we' and 'us'.

This agreement oulines what is acceptable in relation to the use of our products and services. Please note that by placing information on our servers is an acknowledgement that you have read, understood, and agreed to the Terms of Service below.

User Conduct
Our services are prohibited from unlawful purposes that violate the laws of your local jurisdiction. While using our services you may not post materials that are:

• Unlawful
• Threatening
• Abusive
• Defamatory
• Obscene
• Libellous
• Offensive
• Indecent

or otherwise objectionable information of any kind.

Illegal content
Users may not include unacceptable content or links such as:

• Pirated software
• Hacker programs or archives
• ILLEGAL COPYRIGHTED MP3's OR linking to or hosting them.

Any sites promoting illegal activity or presenting content that may be damaging to Wetstone's services are forbidden, this includes links to such material. Wetstone reserves the right to the final decision on what constitutes abuse.

Compensation
Wetstone Technologies accepts no responsibility for any claimed damages, either of a minor or substantial nature, which may arise from Wetstone's servers going off line or being unavailable for any other prevailing reasons. Wetstone will not be responsible for any damage caused due to the loss or corruption of any web material on one of our services.

Technical Support
Wetstone provide technical support relating to your website, hosting, or functionality.

Each paying client is given 1hour free support per month, after which the charge-out rate will remain at $40.00 NZDL per hour unless stated otherwise by Wetstone.

Refusal or discontinuation of service
We reserve the right to refuse, cancel or suspend service without notice, at our sole discretion. Our decision will be final. Wetstone may deny you access to all or part of the service, without notice, if you engage in any conduct or activities that Wetstone, in its sole discretion, believes violates any of the terms of service in this agreement.

No warranties
We make no warranties except that advertised in the Money Back Guarantee policy. Information placed on the Wetstone servers becomes available to all Internet users and it is to be understood that we have no way of limiting or restricting access to such information or protecting such information from copyright infringement.

Account-Holder Identification Information
You must be 18 years of age in order to enter into this binding agreement, and you will be responsible for all use of this account. If under 18 years of age, you need to have parental consent in order to sign up, and the account must then be ordered by the parent or guardian.

You are obliged to provide us with your truthful name, postal address and telephone number, and you have an incessant duty to keep this information current.

Domain Registration Terms and Conditions
We cannot be held responsible for any infringements against registered trademarks and further to this, the registrant of any such Domain name infringement will indemnify Wetstone against any responsibility for such infringements of trademark.

Domain name registration fees are non-refundable and once registered they are irreversible. Domain names will be automatically renewed on an annual basis unless stated otherwise.

Data storage - Backup - Service
No compensation will be payable by Wetstone in the unlikely event of data or service loss. This includes loss of any services, data, earnings or any losses due to hardware failure from one of our servers

It is the client's responsibility to maintain local copies of their website content. If data loss occurs due to inattention in securing their account or by an action of the client, Wetstone may attempt to recover the data from the most recent archive for a NZ$40.00 fee.

Cancellation of accounts
All requests for cancellation of accounts must be emailed to info@wetstone.co.nz with at least 7 days notice. You must include your username and password in your cancellation email (this ensures no one but you can cancel your account).

Payment of Fees
Wetstone Technologies will invoice the client for the full amount due for the commission. On receipt of full payment, Wetstone Technologies will publish the website on their live server, or provide the source code for the site via a download (or cd-rom disk) for the client to upload. Wetstone Technologies reserves the right to alter prices at any time without notice. If a client has commissioned any services from Wetstone Technologies prior to a change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.

Overdue Accounts
Wetstone Technologies expects payment by cheque, credit card or cash within 14 days of the date of invoice. If at any point during the Website Development Cycle a client wishes to cancel, they may do so but will be invoiced an amount that Wetstone Technologies judges to be proportionate to the amount of work completed on the commission.

Refund and Disputes
All payments after the initial 30 days of service to Wetstone are non-refundable. Domain Name Registration fees are non-refundable. All overcharges or billing disputes must be reported within 31 days of the time the dispute occurred.

Refunds for Web Hosting Services
No refunds other than those that qualify for our 30-day money back guarantee will be issued under any circumstances.

Money Back Guarantee
If you become dissatisfied with our services within the first 30 days of your account activation, Wetstone will refund your hosting fee (Excluding Domain registration fee). Any accounts terminated by Wetstone for violating our Terms of Service Policy do not qualify for the 30-day money back guarantee. Clients who have held accounts with us previously are not eligible for the 30 Day Money Back Guarantee under any circumstances. This is to protect our refund guarantee from being abused. Maintenance
Wetstone Technologies does not undertake to maintain or update a client's website as part of the design commission. If a client wishes Wetstone Technologies to maintain or update a web site as a separate commission, Wetstone Technologies will negotiate with the client a maintenance contract appropriate to the amount of work required. Web site maintenance may also be undertaken on a time and materials basis if the client so wishes.

Copyright
The copyright in all material provided by Wetstone Technologies, such as HTML code, graphics, photographs and text, will remain the property of Wetstone Technologies until such time as payment has been made in full, whereupon they will become the property of the client.

Privacy
All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
